NASCARFUELFOREMPLOYEES.COM Service Agreement

1. Definitions. Definitions. "NASCARfuelforemployees.com" is the interactive website operated by AMERICANEAGLE.COM, INC. ("Americaneagle") on behalf of the National Association for Stock Car Auto Racing, Inc. ("NASCAR") on the World Wide Web of the Internet, consisting of information services and content provided by Americaneagle, NASCAR, affiliates of NASCAR and other third parties. "Subscriber" means each person who establishes or accesses a connection and account ("Account") for access to and use of NASCARfuelforemployees.com.

2. General. (A) This Agreement, which incorporates by reference other provisions applicable to use of NASCARfuelforemployees.com, including, but not limited to, supplemental terms and conditions set forth in paragraph 14 hereof ("Supplemental Terms") governing the use of certain specific material contained in NASCARfuelforemployees.com, sets forth the terms and conditions that apply to use of NASCARfuelforemployees.com by Subscriber. By using NASCARfuelforemployees.com (other than to read this Agreement for the first time), Subscriber agrees to comply with all of the terms and conditions hereof. The right to use NASCARfuelforemployees.com is personal to Subscriber and is not transferable to any other person or entity. Subscriber is responsible for all use of Subscriber's Account (under any screen name or password) and for ensuring that all use of Subscriber's Account complies fully with the provisions of this Agreement. Subscriber shall be responsible for protecting the confidentiality of Subscriber's password(s), if any.

(B) NASCAR shall have the right at any time to change or discontinue any aspect or feature of NASCARfuelforemployees.com, including, but not limited to, content, hours of availability, and equipment needed for access or use.

3. Changed Terms. Changed Terms. NASCAR shall have the right at any time to change or modify the terms and conditions applicable to Subscriber's use of NASCARfuelforemployees.com, or any part thereof, or to impose new conditions, including, but not limited to, adding fees and charges for use. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to, posting on NASCARfuelforemployees.com, or by electronic or conventional mail, or by any other means by which Subscriber obtains notice thereof. Any use of NASCARfuelforemployees.com by Subscriber after such notice shall be deemed to constitute acceptance by Subscriber of such changes, modifications or additions.

4. Equipment. Equipment. Subscriber shall be responsible for obtaining and maintaining all telephone, computer hardware and other equipment needed for access to and use of NASCARfuelforemployees.com and all charges related thereto.

5. Subscriber Conduct. (A) Subscriber shall use NASCARfuelforemployees.com for lawful purposes only. Subscriber shall not post or transmit through NASCARFuelforemployees.com any material which violates or infringes in any way upon the rights of others, which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law, or which, without Americaneagle’s and/or NASCAR's express prior approval, contains advertising or any solicitation with respect to products or services. Any conduct by a Subscriber that in Americaneagle's discretion restricts or inhibits any other Subscriber from using or enjoying NASCARfuelforemployees.com will not be permitted. Subscriber shall not use NASCARfuelforemployees.com to advertise or perform any commercial solicitation, including, but not limited to, the solicitation of users to become subscribers of other on-line information services competitive with NASCARfuelforemployees.com.

(B) NASCARfuelforemployees.com contains copyrighted material, trademarks and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music and sound, and the entire contents of NASCARfuelforemployees.com are copyrighted as a collective work under the United States copyright laws. NASCAR owns a copyright in the selection, coordination, arrangement and enhancement of such content, as well as in the content original to it. Subscriber may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content, in whole or in part. Subscriber may download copyrighted material for Subscriber's personal use only. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without the express permission of NASCAR, Americaneagle and the copyright owner. In the event of any permitted copying, redistribution or publication of copyrighted material, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made. Subscriber acknowledges that it does not acquire any ownership rights by downloading copyrighted material.

(C) Subscriber shall not upload, post or otherwise make available on NASCARfuelforemployees.com any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right and the burden of determining that any material is not protected by copyright rests with Subscriber. Subscriber shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission. By submitting material to any public area of NASCARfuelforemployees.com, Subscriber automatically grants, or warrants that the owner of such material has expressly granted Americaneagle and NASCAR the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate and distribute such material (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or hereafter developed for the full term of any copyright that may exist in such material. Subscriber also permits any other Subscriber to access, view, store or reproduce the material for that Subscriber's personal use. Subscriber hereby grants Americaneagle and NASCAR the right to edit, copy, publish and distribute any material made available on NASCARfuelforemployees.com by Subscriber.

(D) The foregoing provisions of Section 5 are for the benefit of Americaneagle, NASCAR and each of their respective subsidiaries, parent companies, affiliates and third party content providers and licensors and each shall have the right to assert and enforce such provisions directly or on its own behalf.

6. Disclaimer of Warranty; Limitation of Liability. (A) SUBSCRIBER EXPRESSLY AGREES THAT USE OF NASCARFUELFOREMPLOYEES.COM IS AT SUBSCRIBER'S SOLE RISK. NEITHER AMERICANEAGLE, NASCAR, NOR THEIR AFFILIATES OR PARENT COMPANIES NOR ANY OF THEIR RESPECTIVE SHAREHOLDERS, MEMBERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, THIRD PARTY CONTENT PROVIDERS OR LICENSORS WARRANT THAT NASCARFUELFOREMPLOYEES.COM WILL BE UNINTERRUPTED OR ERROR FREE; NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF NASCARFUELFOREMPLOYEES.COM, OR AS TO THE ACCURACY, RELIABILITY OR CONTENT OF ANY INFORMATION, SERVICE, OR MERCHANDISE PROVIDED THROUGH NASCARFUELFOREMPLOYEES.COM.(A) SUBSCRIBER EXPRESSLY AGREES THAT USE OF NASCARFUELFOREMPLOYEES.COM IS AT SUBSCRIBER'S SOLE RISK. NEITHER AMERICANEAGLE, NASCAR, NOR THEIR AFFILIATES OR PARENT COMPANIES NOR ANY OF THEIR RESPECTIVE SHAREHOLDERS, MEMBERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, THIRD PARTY CONTENT PROVIDERS OR LICENSORS WARRANT THAT NASCARFUELFOREMPLOYEES.COM WILL BE UNINTERRUPTED OR ERROR FREE; NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF NASCARFUELFOREMPLOYEES.COM, OR AS TO THE ACCURACY, RELIABILITY OR CONTENT OF ANY INFORMATION, SERVICE, OR MERCHANDISE PROVIDED THROUGH NASCARFUELFOREMPLOYEES.COM.

(B) NASCARFUELFOREMPLOYEES.COM IS PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS AGREEMENT.

(C) THIS DISCLAIMER OF LIABILITY APPLIES TO ANY DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF RECORD, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION. SUBSCRIBER SPECIFICALLY ACKNOWLEDGES THAT NEITHER AMERICANEAGLE NOR NASCAR ARE LIABLE FOR THE DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER SUBSCRIBERS OR THIRD-PARTIES AND THAT THE RISK OF INJURY FROM THE FOREGOING RESTS ENTIRELY WITH SUBSCRIBER.

(D) IN NO EVENT WILL AMERICANEAGLE, NASCAR, OR ANY PERSON OR ENTITY INVOLVED IN CREATING, PRODUCING OR DISTRIBUTING NASCARFUELFOREMPLOYEES.COM OR THE NASCARFUELFOREMPLOYEES.COM SOFTWARE, BE LIABLE FOR ANY DAMAGES, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE NASCARFUELFOREMPLOYEES.COM. SUBSCRIBER HEREBY ACKNOWLEDGES THAT THE PROVISIONS OF THIS SECTION SHALL APPLY TO ALL CONTENT ON NASCARFUELFOREMPLOYEES.COM.

(E) IN ADDITION TO THE TERMS SET FORTH ABOVE NEITHER, AMERICANEAGLE, NASCAR, NOR THEIR AFFILIATES, PARENT COMPANIES, INFORMATION PROVIDERS OR CONTENT PARTNERS SHALL BE LIABLE REGARDLESS OF THE CAUSE OR DURATION, FOR ANY ERRORS, INACCURACIES, OMISSIONS, OR OTHER DEFECTS IN, OR UNTIMELINESS OR UNAUTHENTICITY OF, THE INFORMATION CONTAINED WITHIN NASCARFUELFOREMPLOYEES.COM, OR FOR ANY DELAY OR INTERRUPTION IN THE TRANSMISSION THEREOF TO THE SUBSCRIBER, OR FOR ANY CLAIMS OR LOSSES ARISING THEREFROM OR OCCASIONED THEREBY. NONE OF THE FOREGOING PARTIES SHALL BE LIABLE FOR ANY THIRD-PARTY CLAIMS OR LOSSES OF ANY NATURE, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, PUNITIVE OR CONSEQUENTIAL DAMAGES. NEITHER AMERICANEAGLE, NASCAR, NOR THEIR AFFILIATES, PARENT COMPANIES, INFORMATION PROVIDERS OR CONTENT PARTNERS WARRANT OR GUARANTEE THE TIMELINESS, SEQUENCE, ACCURACY OR COMPLETENESS OF THIS INFORMATION. ADDITIONALLY, THERE ARE NO WARRANTIES AS TO THE RESULTS OBTAINED FROM THE USE OF THE INFORMATION.

7. Monitoring. Americaneagle and NASCAR shall have the right, but not the obligation, to monitor the content of NASCARFUELFOREMPLOYEES.COM, including chat rooms and forums, to determine compliance with this Agreement and any operating rules established by Americaneagle and NASCAR and to satisfy any law, regulation or authorized government request. Americaneagle and NASCAR shall have the right in their sole discretion to edit, refuse to post or remove any material submitted to or posted on NASCARFUELFOREMPLOYEES.COM. Without limiting the foregoing, Americaneagle and NASCAR shall have the right to remove any material that Americaneagle and NASCAR, in their sole discretion, finds to be in violation of the provisions hereof or otherwise objectionable.

8. Indemnification.  Subscriber agrees to defend, indemnify and hold harmless Americaneagle, NASCAR, their respective affiliates and parent companies and each of their respective shareholders, directors, officers, employees, members, personnel, assigns and agents from and against all claims and expenses, including attorneys' fees, arising out of the use of NASCARFUELFOREMPLOYEES.COM by Subscriber or Subscriber's Account.

9. Termination. Either Americaneagle, NASCAR, or Subscriber may terminate this Agreement at any time. Without limiting the foregoing, NASCAR or Americaneagle shall have the right to immediately terminate Subscriber's Account in the event of any conduct by Subscriber which Americaneagle or NASCAR, in its sole discretion, considers to be unacceptable, or in the event of any breach by Subscriber of this Agreement. The provisions of Sections 5(B), 5(C), 5(D), 6, 8, 10 and this Section 9 shall survive termination of this Agreement.

10. Trademarks. NASCAR and NASCARFUELFOREMPLOYEES.COM, and each of their logos are trademarks of NASCAR. All rights reserved. All other trademarks appearing on NASCARFUELFOREMPLOYEES.COM are the property of their respective owners.

11. Third Party Content. NASCAR and Americaneagle is a distributor (and not a publisher) of content supplied by third parties and Subscribers. Accordingly, NASCAR and Americaneagle have no more editorial control over such content than does a public library, bookstore, or newsstand. Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties, including information providers, Subscribers or any other user of NASCARFUELFOREMPLOYEES.COM, are those of the respective author(s) or distributor(s) and not of NASCAR or Americaneagle. Neither NASCAR, Americaneagle, nor any third-party provider of information guarantees the accuracy, completeness, or usefulness of any content, nor its merchantability or fitness for any particular purpose. (Refer to Section 6 above for the complete provisions governing limitation of liabilities and disclaimers of warranty.) In many instances, the content available through NASCARFUELFOREMPLOYEES.COM represents the opinions and judgments of the respective information provider, Subscriber, or other user not under contract with Americaneagle or NASCAR. Americaneagle or NASCAR neither endorses nor is responsible for the accuracy or reliability of any opinion, advice or statement made on NASCARFUELFOREMPLOYEES.COM by anyone other than authorized Americaneagle or NASCAR employee spokespersons while acting in their official capacities. Under no circumstances will Americaneagle or NASCAR be liable for any loss or damage caused by a Subscriber's reliance on information obtained through NASCARFUELFOREMPLOYEES.COM. It is the responsibility of Subscriber to evaluate the accuracy, completeness or usefulness of any information, opinion, advice or other content available through NASCARFUELFOREMPLOYEES.COM. Please seek the advice of professionals, as appropriate, regarding the evaluation of any specific information, opinion, advice or other content.

12. Miscellaneous. This Agreement and any operating rules for NASCARFUELFOREMPLOYEES.COM established by Americaneagle and NASCAR constitute the entire agreement of the parties with respect to the subject matter hereof, and supersede all previous written or oral agreements between the parties with respect to such subject matter. This Agreement shall be construed in accordance with the laws of the State of Florida, without regard to its conflict of laws rules. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. The section headings used herein are for convenience only and shall not be given any legal import.

13. Copyrights and Copyright Agent. Americaneagle and NASCAR respect the rights of all copyright holders and in this regard, Americaneagle and NASCAR have adopted and implemented a policy that provides for the termination in appropriate circumstances of subscribers and account holders who infringe the rights of copyright holders. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide NASCAR's Copyright Agent the following information required by the Online Copyright Infringement Liability Limitation Act of the Digital Millennium Copyright Act, 17 U.S.C. ω 512:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  2. Identification of the copyright work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material;
  4. Information reasonably sufficient to permit us to contact the complaining party;
  5. A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. THE "NASCAR FUEL FOR EMPLOYEES SWEEPSTAKES" OFFICIAL RULES 

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCE OF WINNING. OPEN ONLY TO CURRENT EMPLOYEES OF OFFICIAL PARTNERS OF NASCAR WHO ARE MEMBERS OF NASCARFUELFOREMPLOYEES.COM, PERMANENT LEGAL RESIDENTS OF THE UNITED STATES OF AMERICA, AND 21 YEARS OF AGE OR OLDER AS OF JANUARY 1, 2014. VOID WHERE PROHIBITED BY LAW.

1. Description: The "NASCAR Fuel for Employees Sweepstakes" (the "Sweepstakes") begins at 12:00:01 AM ET on Monday, January 1, 2014 and ends at 11:59:59 P.M. on December 31, 2014 ("Sweepstakes Period"). Each day of the Sweepstakes Period is defined by Eastern Time ("ET"). The Sweepstakes consists thirty-nine (39) different entry periods (each an "Entry Period") and fifty-one (51) weekly sweepstakes drawings ("Weekly Drawings"). Each Weekly Sweepstakes begins at 12:00:01 AM on a Monday and ends at 11:59:59 PM the following Sunday (see chart below for the specific dates for each Entry Period). The Sponsor’s database computer is the official time-keeping device for this Sweepstakes. By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these OFFICIAL RULES and the decisions of the National Association for Stock Car Auto Racing, Inc., (NASCAR) (hereinafter, "SPONSOR"), which shall be final and binding in all respects.

2. How to Enter: To participate in any of the Weekly Sweepstakes, during the Sweepstakes Period, access www.nascarfuelforemployees.com ("Website"), login and click on the "Prizes" tab, fully read these Official Rules and check the box indicating you agree to be bound by these Official Rules, and click on the Sweepstakes "Play Now" button to see that particular week’s trivia question. Select one (1) of the four (4) answer choices and click ‘Submit" to be entered into that particular week’s Weekly Drawing ("Entry"). Questions may pertain to that week’s NASCAR Sprint Cup Series™ race (check your local listing for date and start time). Participants can only register and enter the Sweepstakes under one (1) user password and one (1) email address. To be eligible for a particular Weekly Sweepstakes, Entries must be received by 11:59:59 P.M. the Sunday of each Entry Period. Entries for the last Weekly Sweepstakes must be received by 11:59:59 P.M. on December 31, 2014. Limit one (1) Entry per person per email address per Entry Period.

Multiple entries in excess of the stated limit by the same person will be disqualified. If an entrant resides in a jurisdiction that deems him/her to be a minor, he/she must obtain parental/legal guardian consent prior to entering or submitting any personally identifiable information. Proof of delivery or receipt of Entry will not be deemed by Sponsor as proof of entry. Any attempted form of entry other than as described herein is void.

3. Eligibility: This Sweepstakes is only open to current employees of OFFICIAL PARTNERS OF NASCAR, who are registered members of nascarfuelforemployees.com, permanent legal residents of the United States of America, physically located and residing therein and who are 21 years of age or older as of January 1, 2014 and who possess a valid Social Security, personal tax I.D. number or Social Insurance Number issued by the appropriate government agency. Employees of Sponsor and its affiliates and each of their respective, shareholders, officers, directors, agents, members, personnel and assigns (collectively, the "RELEASED PARTIES") and members of their immediate families (spouses, children, siblings, parents) and/or persons living in the same household as such persons, whether related or not are ineligible to enter the Sweepstakes.

4. Prizes/Odds of Winning: Fifty One (51) Weekly Sweepstakes Prizes (one (1) prize per Weekly Sweepstakes). Each prize given away during the Weekly Drawings will be listed on the Website and can be found by clicking on the "Prizes" tab. An accurate description and retail value of each prize can be found here. Limit one (1) Weekly Sweepstakes Prize per person/family/household within thirty days of winning a prize. Odds of winning a Weekly Sweepstakes prize depends on the total number of eligible Entries with the correct answer to the trivia question received for that particular Weekly Sweepstakes. All federal, state, or other taxes are sole responsibility of winners. No substitution or transfer of prizes or cash redemptions permitted by the Winners. Sweepstakes winners will not receive the difference between the ARV and actual retail value in cash, if any.

5. Random Drawing and Notification of Potential Winners: For each Weekly Sweepstakes one potential winner will be randomly selected from among all eligible Entries received for that particular Weekly Sweepstakes in a drawing held on the ‘Drawing On or Before’ date specified in the chart herein. All drawings will be conducted by NASCAR, Inc. Potential winners (their parent or legal guardian, if winners are residents of a jurisdiction that does not deem them to be of the age of majority) will be notified by email or telephone within five (5) business days of the drawing date. Once notified, potential winner will have three (3) business days from the date the email was sent within which to respond to the prize notification email, or his/her entry will be disqualified and his/her prize forfeited and an alternate potential winner may be selected at Sponsor’s sole discretion. If a potential winner cannot be reached after a reasonable effort has been exerted, if he/she is found to be ineligible, if his/her prize notification is returned as undeliverable, or if he/she cannot or does not comply with these Official Rules, that potential winner will be disqualified and an alternate potential winner may be selected at Sponsor’s sole discretion. If an entrant changes his/her email address after he/she enters the Sweepstakes, it is his/her sole responsibility to notify the Sponsor by postal mailing notice to the address listed below, to be received by the end of the Sweepstakes Period. Winners’ names may be announced (subject to verification) on www.nascarfuelforemployees.com.

6. General Conditions: Sweepstakes is subject to these Official Rules and all federal, state and local laws and regulations (collectively "Rules and Laws"). Potential winners of Weekly Sweepstakes (if a resident of a jurisdiction that deems a winner to be a minor, his/her parent or legal/guardians), at Sponsor’s sole discretion, will be required to execute, sign, have notarized and return an unaltered original Affidavit of Eligibility, a Liability Release, a Publicity Release (where legal), an IRS TAX form W9 and any other documentation that Sponsor requires (collectively "Affidavit/Release") within five (5) days after receipt by potential winners of Weekly Sweepstakes or such potential winners of Weekly Sweepstakes may be disqualified and an alternate potential winner of Weekly Sweepstakes may be selected at Sponsor’s sole discretion. By entering this Sweepstakes, entrants agree to all of the following: to be bound by these Rules and Laws, as well as the decisions of the Sponsor which are final and binding in all respects; to indemnify and hold harmless the Released Parties from any and all liability resulting or arising from the Sweepstakes; to release all rights to bring any claim, action or proceeding against the Released Parties; and to waive any rights to claim ambiguity with the Official Rules. If a winner is a resident of a jurisdiction that does not deem him/her to be of the age of majority, prize will be awarded in the name of such minor’s parent/legal guardian. Once submitted Entry information becomes the sole property of the Sponsor and will not be returned. Sponsor has the right to modify, use, assign, and/or dispose of such Entries however it sees fit and for any purpose without any notice or compensation to entrant or any third party. Any personal information supplied by entrants to Sponsor will be subject to Sponsor’s Privacy Policy (and terms and conditions) posted at the NASCARfuelforemployees.com Website. Thus, except where prohibited by law and Sponsor’s Privacy Policy: (1) entry and/or a winner’s (winner’s parent/legal guardian, if winner is a minor) acceptance of a prize constitutes permission for the Released Parties to use winner’s name, address (city and state), photo, likeness, biographical information, statement and voice for advertising/publicity purposes worldwide and in all forms of media (including posting on Website, and/or public relations press releases), in perpetuity, without further notice to or compensation in connection with said Sweepstakes or any prize awarded and (2) Sponsor has the right to modify, edit, adapt, electronically alter, use, assign and/or dispose of such Entries however it sees fit and for any purpose without any notice or compensation to entrant or any third parties. Sponsor will not provide any personally identifying information of minors, regardless of its source, to any third party without the express written consent of entrant’s parent/legal guardian. Any person attempting to defraud or tamper with this Sweepstakes will be prosecuted and will not be eligible for a prize. If, for any reason, the Sweepstakes is not capable of running as originally planned by reason of infection by computer virus, worms, bugs, tampering, hacking, unauthorized intervention, fraud, technical failures or any other causes which, in sole opinion of the Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor at its sole discretion, reserves the right to cancel, terminate, suspend or modify the Sweepstakes or any portion(s) thereof and conduct any or all the drawings from among all salvageable eligible Entries for any or all Weekly Drawings, if any, or as otherwise deemed fair and equitable by Sponsor.
